Health Law: Case Law

This research guide is designed to introduce the various health law resources that the Seton Hall Law community has access to.

Databases

Instead of performing a broad case search, consider using one of the specialized health law databases to streamline your search.  

  • Health Law Cases (Westlaw)
  • Healthcare Law Topic (Lexis)
    • On the tabs under the search bar, under "Content" select "Cases", and under "Practice Areas & Topics" select "Healthcare law".  Enter your keywords.

Don't forget that annotations in treatises and looseleafs will provide citations for relevant health law cases.

Finding Tools

Digests:  Case headnote summaries are organized by subject so that you you can briefly scan headnotes under broad topics and follow the citation to potentially relevant cases.  

Key Numbers: The key number system is a Westlaw product that summarizes, organizes and categorizes each point of law found in each reported case.  Find a case that is on point and use the Key Number to lead you to more cases that discuss the point of law you are interested in.  Alternatively, start by reviewing Key Number System and drill down topics or run a keyword search until you find the point of law that you would like to read cases on.

Topics: The Topic system is a  LexisNexis product that summarizes, organizes and catagorizes each point of law found in each reported case.  Find a case that is on point and use the "Shepardize - Narrow by this Headnote" feature to lead you to more cases that discuss the point of law you are interested in.  Alternatively, start by clicking "Browse Topics" button above the Lexis Advance bar and drill down the topics.  Once you find the relevant topic, click the topic click "Add this topic to the search" and run a keyword search.
